Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PostAi platform ("Service") operated by PostAi ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering contracts to use the Service. By using the Service you represent that these conditions are met.

2. Roles and Accounts

The Service supports three roles:

• Homeowner / Renter: receive quotes, list items, book contractors, earn micro-credits.
• Scout: capture property photos, generate and deliver quotes, claim micro-jobs, earn referral credits per accepted booking.
• Business / Contractor: receive qualified leads, accept bookings, configure rate sheets, receive payouts.

You are responsible for maintaining the confidentiality of your account credentials.

3. Acceptable Use

You agree not to:

• Capture, photograph, or collect data about properties without the property owner's implicit or explicit consent or without lawful access to the relevant public right-of-way or property.
• Use the Service to harass, stalk, or intimidate any person.
• Submit false, misleading, or fabricated property data, quotes, or listing information.
• Use automated scripts or bots to interact with the Service.
• Reverse-engineer, decompile, or extract proprietary data from the platform.
• Circumvent or attempt to circumvent the lead-payment system (e.g., contacting property owners outside the platform after obtaining their data from the Service).
• List prohibited items (weapons, controlled substances, counterfeit goods, items that violate third-party intellectual property rights, or anything illegal in your jurisdiction).

4. Physical Mail (PostGrid)

The Service allows scouts and contractors to send physical USPS letters to property owners. You are responsible for ensuring that your mailing activity complies with applicable law, including CAN-SPAM and any state do-not-mail laws. PostAi maintains an opt-out blacklist; directing mail to a property whose owner has opted out is prohibited and may result in account suspension.

Each letter sent via the Service is billed at the rate shown in the interface at the time of sending. Charges are non-refundable once the letter has been accepted by PostGrid for printing.

5. SMS Messaging

By providing a phone number you consent to receive transactional SMS messages from PostAi (quote summaries, booking confirmations, job alerts). Standard message and data rates may apply. Reply STOP to opt out at any time.

6. Payments and Fees

Payments are processed by Stripe, Inc. By using the payment features you agree to Stripe's Connected Account Agreement. The current platform fee is 10% of each booked job payment; 5% is held as a scout referral reserve and released automatically upon job completion. Fees are subject to change with 30 days' notice.

7. Scout Earnings

Scouts earn a referral credit when a homeowner books a contractor from a flyer the scout generated. Credits are disbursed via Stripe Connect after the booking is confirmed. Scouts are independent contractors, not employees of PostAi. PostAi does not guarantee any minimum earnings.

8. Property Data

Property data (owner names, square footage, lot size) is sourced from public county assessor records via third-party APIs. PostAi makes no representation as to its accuracy or completeness. Do not rely on this data for legal, financial, or real-estate decisions.

9. User Content

You retain ownership of content you submit (photos, descriptions, voice notes). You grant PostAi a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely to operate the Service. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.

10. Intellectual Property

All platform code, design, trademarks, and proprietary data (including aggregated lead and pricing data) are owned by PostAi and protected by applicable law. Nothing in these Terms transfers any ownership rights to you.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. POSTAI DOES NOT GUARANTEE THE ACCURACY OF QUOTES, PROPERTY DATA, OR CONTRACTOR QUALIFICATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless PostAi, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law provisions. You agree to resolve any dispute with PostAi through binding individual arbitration under the rules of the American Arbitration Association (AAA), and waive any right to participate in a class action.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app. Continued use after the effective date constitutes acceptance.
